Testimony has begun in an attempted capital murder case

A secret service agent testified Tuesday that a Greenville woman admitted to stuffing a diaper wipe down her newborn daughter’s throat on Halloween night of 2009.  Rod Woodward was on the stand during the first day of the trial of Lola Danielle Cherry.  Cherry is being tried for capital murder.

 

On cross examination, Woodward said Cherry’s admission came at the end of between 90 minutes and two hours of questioning and she did not have legal counsel at the time.  Woodward also said Cherry was read her rights and signed a statement saying she understood.  The defense objected to the admission of the signed and sworn statement concerning the incident into evidence.

 

Trial is expected to conclude Thursday.
