If a Virginia attorney and tea party activist has his way, Newt Gingrich’s name will be placed on the state’s Super Tuesday primary ballot.

Jonathan Moseley of Reston, Virginia says he filed the suit Thursday in the Circuit Court of Richmond County. It contends that Gingrich achieved the 10,000 required signatures and that many were improperly excluded. Currently only Ron Paul and Mitt Romney qualify for the primary, and Rick Perry’s campaign is also challenging his exclusion in court. Moseley is acting independently of Gingrich, but encourages him to join the suit.
