Lemons seeks release after reversed conviction

Greenville – A Rains County man remains in custody despite having his conviction for aggravated assault overturned in February. The court now awaits a formal mandate in the case of James Earl Lemons, of Point.

A hearing is scheduled Monday after Lemon's attorney filed a motion Thursday seeking his client's release and the setting of a reasonable bail in the case.

Lemons was convicted by a jury in March 2010 and sentenced to 17 years in prison. But in February the 6th Appellate District Court of Texarkana remanded the case back to court after ruling Lemons received ineffective assistance from his defense counsel.

Lemons is accused of shooting the husband of his girlfriend in September 2008 near Merit.
