Commerce man given 40 years in prison

Commerce – A prison sentence is handed down in a Commerce shooting case. Howard Weatherall Junior was found guilty Tuesday of aggravated assault with a deadly weapon in connection with the shooting of a male victim in September 2007. Weatherall was also found guilty of unlawful possession of a firearm by a felon following the one day trial. On Wednesday, a judge sentenced Weatherall to 40 years in prison on both counts, to run concurrently. Typically, a charge of aggravated assault carries a maximum sentence of up to 20 years in prison, although Weatherall's previous criminal record enhanced the potential punishment he could receive for the conviction.
