Davila-Rodriguez back in court for first time since mistrial

GREENVILLE - Prosecutors may decide this week what to do in the case of a Mexican national who allegedly fired upon Greenville officers in July 2010.

Two years after he was first placed into custody, Francisco Javier Davila-Rodriguez will again appear in court as part of a status hearing.

He was first scheduled for trial in September 2011, but the case was reset due to a lack of available jurors. Then in February, the jury declared a mistrial despite more than eight hours of deliberations.

Davila-Rodriguez has been indicted on four counts of aggravated assault with a deadly weapon against a public servant, one count of deadly conduct and an additional count of aggravated assault with a deadly weapon. He’s pleaded not guilty to all six charges.
